TOWN OF WESTERLY PROPOSED ORDINANCE Notice is hereby given that a Public Hearing will be held in the Council Chambers, Town Hall, Westerly, Rhode Island, on Monday, April 3, 2017, at 6:00 o'clock p.m., or as close to that time as possible, in accordance with the Home Rule Charter of the Town of Westerly, to consider the following Proposed Ordinance entitled: "AN ORDINANCE IMPOSING A 180-DAY MORATORIUM ON PERMITTING ANY NEW MINERAL EXTRACTION AND QUARRYING OPERATIONS WITHIN THE TOWN UNTIL A MINERAL/QUARRYING EXTRACTION ORDINANCE IS ENACTED BY THE TOWN" The TOWN OF WESTERLY hereby adopts a Moratorium Ordinance as follows: WHEREAS, the Town of Westerly (hereinafter the "Town") has a strong desire to develop a mineral/quarrying extraction ordinance to address, monitor and regulate existing business practices and the potential for increased development from the extraction of certain materials from the earth, especially the quarrying of granite in various sites or potential quarrying sites throughout the Town; and WHEREAS, this increased development pressure is unanticipated and regulations are not adequately provided for in the Town's current Land Use Zoning Ordinance or in other ordinances of the Town to ensure proper operation and protection of the Town's resources; and WHEREAS, the Town's desire is to balance the interests of the business community with the health, safety and general welfare of the citizens, particularly as it relates to byproducts and adverse operational impacts associated with mineral extraction activities and quarrying operations; and WHEREAS, there is a likelihood that some areas of the Town may be adversely impacted by this development pressure due to the arguable nonexistence of any enforceable regulations or restrictions on the location, nature and use of sites for mineral extraction, the possible demand for permits for mineral extraction, or at least the grossly inadequate nature of the existing regulations; and WHEREAS, permitting of such mineral extraction activities pursuant to the current Land Use Zoning Ordinance could pose serious threats to the public health, safety and welfare of the residents of the Town by conducting such mineral extraction activities without adequate provisions for issues of safety, noise, vibration, dust, setback distances, land use compatibility, and screening; and WHEREAS, in light of these competing interests, the Town desires to place a Moratorium in effect for any new businesses located where proposed mineral extraction and quarrying activities are to take place while the Town develops and enacts its mineral/quarrying extraction ordinance; and WHEREAS, the Town will need at least one hundred eighty (180) days to develop and implement the necessary amendments to its Land Use and Zoning Ordinance, and possibly to other ordinances of the Town, to develop and establish these regulations; and WHEREAS, amendments to its Land Use and Zoning Ordinance, and possibly to other ordinances of the Town, will require a public hearing(s) and action by the Planning Board and the Town Council; and WHEREAS, in the JUDGMENT of the Town, these facts require the following Moratorium Ordinance to be enacted because the application of the existing Comprehensive Plan, Land Use Zoning Ordinance and other applicable Town ordinances are inadequate to prevent serious public harm from mineral extraction activities within the Town; NOW, THEREFORE, the Town of Westerly hereby ordains that a MORATORIUM is hereby imposed for a period of one hundred eighty (180) days on any new mineral extraction, including but not limited to the quarrying of granite or other minerals, that is not currently permitted (by written permit, court order or otherwise by consent of the Town), approved and/or under construction; and BE IT FURTHER ORDAINED, that said MORATORIUM shall not apply to existing extraction operations at the recognized mineral extraction and quarrying operations located within the Town. As such the Planning Board, the Department of Development Services, the Building Inspector or Zoning Enforcement Officer, as well as all Town agencies and all Town employees shall neither accept nor approve applications, plans, permits, licenses, and/or fees for any new construction or uses governed by this Moratorium Ordinance for mineral extraction for the period of time described below; and BE IT FURTHER ORDAINED, that any provisions of the Town's ordinances that are inconsistent or conflicting with the provisions of this Moratorium Ordinance are hereby repealed to the extent that they are applicable for the duration of the moratorium hereby ordained; and BE IT FURTHER ORDAINED, that this Moratorium Ordinance may be extended by the Town Council, after notice and hearing, for additional 180-day periods if the Town Council finds that: 1. The problem giving rise to the need for this Moratorium Ordinance still exists; and 2. Reasonable progress in furtherance of studying, developing and enacting a Mineral/Quarrying Extraction Ordinance is warranted. SEVERABILITY CLAUSE: To the extent any provision of this Moratorium Ordinance is deemed invalid by a court of competent jurisdiction, the balance of the Moratorium Ordinance shall remain valid. EFFECTIVE DATE and RETROACTIVITY CLAUSE: This Moratorium Ordinance shall take effect upon passage and shall have no retroactive effect to existing mineral extraction and quarrying operations.
